GENERAL CONDITIONS & PURCHASE AGREEMENT

The following general conditions are applied to the purchase agreement you as a consumer conclude with Espíritu Santo, organization number 8011276659. To protect your interests as a customer, the provisions of the Consumer Purchase Act (SFS 1990:932), the Distance Contracts Act (SFS 2005:59) and the GDPR (SFS 2018:218) on all purchases at www.espiritusanto.se 

PAYMENT

Within Sweden

All prices are stated in Swedish Kronor (SEK), including VAT. The price that applies is the one stated on the website at the time of the order. For purchases within Sweden, we use the Klarna Checkout payment solution where you can easily choose to pay by invoice, partial payment, card, direct payment or Swish. Read more about Klarna's conditions here  When payment is made via Klarna, a secure credit check is done online. You must enter a social security number or organization number as well as registered address. The invoice is sent by e-mail in connection with the order being handled by us, with a payment period of 14 calendar days. In case of late payment, a reminder is sent out and then a reminder fee of SEK 50 is also charged as well as late payment interest at 24% per year + current reference rate. Payment can also be made via bank, debit or credit card linked to Visa, MasterCard or American Express. Please note that the delivery recipient's name and address must match the card/account holder's name and address. Espiritu Santo does not charge any additional fees for card payments. We use security standards developed by VISA and Mastercard for payments over the Internet. The transfer takes place with secure SSL encryption. This means that no unauthorized person can see your card details.

Outside of Sweden

When a delivery country other than Sweden is selected in the shopping basket, the prices are shown in Euros (€). Currently, it is not possible to shop with us outside the EU. The price that applies is the one stated on the website at the time of the order. Please note that we currently only ship within the EU.

DELIVERY

Delivery cost

For small and medium-sized packages, the following fee applies for delivery:

  • Free shipping within Sweden for orders over SEK 599
  • Shipping cost within Sweden: SEK 49
  • Outside Sweden, within the EU: SEK 149 Minimum order SEK 200 Free shipping on orders over SEK 1000

For some large stock and order items, a product-specific shipping fee may apply. In the special cases where we charge a product-specific shipping fee, it is either automatically added to the shopping cart or manually via email.

Delivery time

We offer a standard delivery time of 1-3 working days within Sweden, after your order has been sent from us. Within the EU, the delivery time is 2-7 working days. In case of a large order intake or a delivery delay from the supplier, in some cases stock items may have a longer delivery time. If the notification is delayed and you use the package number to see that your package has arrived, it works to pick up the package with the package number and identification. Made-to -order items are items that we do not normally stock and that have special delivery conditions. The delivery times given for ordered goods are approximate. When ordering several goods with different delivery times at the same time, all goods are sent in one shipment when all goods have arrived at our warehouse.

Availability

Once we have received your order, you will receive an automatic email confirming your order. Please note that the email confirmation is only a confirmation that we have received your order and not an acceptance of your order. The transaction will take place when we approve your purchase. Once the order has been processed, you will receive a delivery confirmation via email. Espíritu Santo does not guarantee that all items in stock on the Site will be in stock at the time of your order. In the event that an item is unavailable or delayed, you will be contacted by email shortly. If this happens, you have the option to cancel the order.

Home delivery and agents
All our goods are sent primarily through Postnord AB. For some special deliveries, agent delivery through DHL is used.

RETURNS

When buying in our online store or by phone, the Distance Contracts Act applies. This means that the customer has the right to cancel their purchase within 14 calendar days of receiving the item. In order to use the right of withdrawal, it is required that the product and its packaging material are in undamaged condition. If a product or its packaging shows defects, we reserve the right to refuse return or make a reasonable reduction of the refund amount. Therefore, be careful when receiving and unpacking products that you may later want to return. We do not accept returns of products that have been used privately or for commercial purposes. We do not exchange products.

When using their right of withdrawal, the customer is responsible for the return shipping. The return must be sent with a return shipping slip issued by Espíritu Santo and in such a way that the product is not damaged during transport. Espíritu Santo is not responsible for any transport damage during return shipping. Returns are normally handled within 1-2 weeks and the return cost is charged in connection with the refund.

The fee for returns varies depending on the country of order and package size. For small and medium-sized packages, the following fee applies for returns:

  • Sweden: SEK 49
  • Europe: €15

Specify which product and size your request refers to, as well as information about where you live, and we will have the basis to calculate the return shipping cost by emailing info@espiritusanto.se

Exceptions to the right of withdrawal apply to ordered goods and gift cards. Exemptions from the right of withdrawal also apply to art prints, books and magazines. The right of withdrawal also does not apply to hygiene articles (e.g. perfume, skin & body care) where seals or similar have been broken.

Instructions for returns:

  1. First check that your return meets our return conditions
  2. Contact info@espiritusanto.se and ask for a return shipping slip (state order number)
  3. Pack the products you wish to return carefully
  4. Print the return shipping slip that you attach to the package and hand it in to your nearest Postnord representative

Fee for unclaimed package or failed delivery attempt

If you regret it and don't want your order after the package has already been sent from us? You must then pick up the package at your delivery point and send it back to us as a return. A fee of SEK 149 is added to packages not collected. The fee corresponds to the cost of administration & return that Postnord charges. From the received invoice, the payment period is 30 days.

In cases where packages are returned to Espíritu Santo because the customer did not redeem the package from the delivery point, was not available at the given telephone number for notification, refused to accept the delivery or provided incorrect information, a fee is charged. For small and medium-sized parcels, the following fee applies for unclaimed shipments or failed delivery attempts:

  • Sweden: SEK 149
  • Europe: €25

The fee is charged by deducting the amount of the fee from the order amount which is refunded after the return arrives at Espíritu Santo. In cases where the recipient is not present at the time of delivery and wants the order sent again, a cost for a new delivery attempt will be added.


Complaints

The customer has the right to complain about a product if it is affected by manufacturing defects. Contact Espíritu Santo within a reasonable time from the time errors have been discovered at info@espiritusanto.se and attach clear pictures of the faulty item. We review all complaint cases individually and return with information via email shortly. Only original faults are covered by the right of complaint, the right of complaint covers e.g. not defects caused by normal wear and tear or improper use. In the case of approved complaint cases, we are responsible for extra shipping costs. We primarily take care of repairing or replacing the product with a new copy. If this is not possible, we will issue a refund.


Transport damage

Check the goods for any damage when you receive the delivery. In order for goods with visible, external transport damage to be able to be claimed with us, the damage must have been noted on the agent. If you discover hidden faults or transport damage after opening the package, please contact info@espiritusanto.se directly. Attach clear pictures of the defect and packaging. In order for us to be able to claim transport damage to the shipping company, we need to report the transport damage within 1-3 days. We are therefore grateful if you report the damage within this time.

All attempts at fraud are reported to the police. Espíritu Santo reserves the right to cancel a purchase if fraud is suspected. If you are under 18 years of age, you need a guardian's permission to order from us.

We strive to reproduce colors and textures on our website as well as possible. How colors are rendered depends, among other things, on the device, monitor settings and other factors. This together means that there may be a certain difference between how a product is reflected in the image and in reality.

We reserve the right to subsequently correct any incorrect information on our website. We reserve the right for any errors in, among other things, product information, price, shipping and stock balance. Even after the purchase has been completed and the order confirmation has been sent, we reserve the right to correct information in the event of any errors.

Force majeure

In the event of war, natural disaster, strike, transport disruption, illness, import/export ban or other comparable circumstance beyond Espíritu Santo's control, Espíritu Santo is released from fulfilling contractual obligations. Such exemption also applies under the condition that Espíritu Santo's business cannot be conducted under satisfactory conditions. In the event of force majeure, both the customer and Espíritu Santo have the right to fully or partially cancel the agreement without obligation to fulfill obligations or liability for damages. The customer must be notified immediately if there are any of the above-mentioned circumstances that could lead to the application of this provision.
